Autumn Cloud LLC, a privately held non-practicing entity, filed 15 enforcement actions alleging infringement off two patents for storage and management of data on a network against airline and media companies.
The suits, all field in the U.S. District Court in Marshall, Texas, name United Continental Holdings Inc. and Virgin America, and Twitter Inc., Groupon Inc., and Pinterest Inc.
Other named defendants are Kayak Inc., Ooyala Inc., SugarSync Inc., Tripadvisor Inc., Brightcove Inc, Deft Media Inc., Kaltura, Travelzoo Inc., Lonely Planet and Radio One Inc.
The patents in suit are U.S. Patent No. 7,606,843 and 8,239,347, each entitled “System and Method for Customizing the Storage and Management of Device Data in a Networked Environment.”
According to the complaints, on October 20, 2009, the patents were issued to Vigilos Inc., with Bruce Alexander and David Antal named as the inventors. On March 28, 2014 Vigilos assigned all rights, title and interest in and to the ’843 patent and the ’347 patent to Olivistar LLC. On June 23, 2016, Olivistar assigned all rights, title and interest in and to the patents to Autumn Cloud.
Autumn Cloud alleges that the ’843 patent and the ’347 patent are directed to novel systems and methods for customizing the storage and archival of device data according to device data attributes. The method may be implemented in a system including monitoring devices generating monitoring device data, an archive server processing the archival of monitoring device data and a client computer configuring the archival of monitoring device data using a graphical user interface.
The alleged infringers use a mobile device, onto which an app has been downloaded, to generate data archive profiles pertaining to the user’s data and the user’s device, which data is processed by a server and stored on a database.
The complaints allege direct infringement, indirect infringement, willful infringement and seek a declaration that the patents are valid and enforceable and infringed plus damages and attorney fees.
